Garage Bread Pty Ltd (we, us, our) operates this website and supplies artisan food and bakery products to customers in Melbourne VIC and surrounding areas. These terms apply to all orders, enquiries and website use. Nothing in these terms limits any rights you have under Australian Consumer Law.
2. Orders and Acceptance
An order placed through this website, by email or through any other channel is an offer to purchase. A contract is formed only when we confirm your order in writing. We reserve the right to decline any order, including where products are unavailable, where delivery cannot be arranged, or where we reasonably suspect the order is not genuine.
3. Pricing and Payment
All prices are quoted in Australian dollars and, unless stated otherwise, include GST. Prices may change without notice; the price payable is the price confirmed at the time we accept your order. Payment is due by the method and within the timeframe stated in your invoice or quote. We may suspend supply if payment is overdue.
4. Delivery
Delivery dates are estimates only and are not guaranteed. Risk in products passes to you on delivery to the address you provide. You must ensure the delivery address and any access instructions are accurate and complete. Additional charges may apply for redelivery where the first attempt fails due to information you supplied being incorrect.
5. Food Products and Storage
Our bakery products are perishable and must be stored and consumed in accordance with any labelling or advice we provide. You are responsible for inspecting products on delivery. While we take care in production, packaging and transport, we cannot guarantee products remain at peak freshness once delivered. Please advise any dietary requirements before ordering; our products may contain or come into contact with common allergens including gluten, nuts, dairy, eggs and soy.
6. Australian Consumer Law
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to cancel your order and receive a refund for the price paid, or compensation for any reduction in value. For minor failures, we may choose to provide a replacement, repair or refund within a reasonable time. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded.
7. Limitation of Liability
To the fullest extent permitted by law, Garage Bread Pty Ltd is not liable for indirect or consequential loss, including loss of profit or business opportunity, arising from your use of this website or our products. Where liability cannot be excluded, our total liability is limited, at our option, to the resupply of the products or the cost of having the products resupplied, except where such limitation is not permitted under the Australian Consumer Law.
